Harvey Weinstein’s Sex Trafficking Lawsuit Allowed To Move Forward

Embattled Harvey Weinstein has lost his bid to have a sex trafficking lawsuit filed against him dismissed.
Aspiring British actress Kadian Noble launched legal action in New York in November, claiming the movie producer sexually assaulted her at a hotel in Cannes, France, groping her breasts, refusing to let her leave his room, rubbing her vagina, and forcing her to pleasure him to climax, as he held her down.
In her lawsuit, she argued Weinstein’s alleged actions were a violation of the sex trafficking statute, which prohibits people from recruiting others to engage in a sex act through means of force, threats of force, fraud or coercion in interstate or foreign commerce.
Noble also named the movie mogul’s brother Bob and executives at their production film, The Weinstein Company (TWC), for reportedly facilitating the sex acts by either knowing of, or recklessly disregarding, Harvey’s pattern and practice of traveling abroad “to entice or recruit or solicit young female actors with the promise of roles in upcoming TWC projects…”
Harvey’s lawyers hit back at the sex trafficking allegations, insisting that because nothing of value was exchanged, the supposed incident did not fall under the statute.
However, their bid for dismissal was rejected on Tuesday (14Aug18), when Manhattan Federal Court Judge Robert Sweet ruled the civil lawsuit can continue, as there is precedent for applying the sex trafficking law to cases involving “defendants who have lured women, under false pretenses, with lucrative promises for sexual purposes”, reports The Associated Press.
There was some good news for Bob Weinstein though – he was dropped from the lawsuit as Noble had failed to provide enough evidence to suggest he knew about Harvey’s alleged bad behavior.
Weinstein, who is already facing multiple sex assault criminal charges in the Big Apple, has denied all allegations of non-consensual sex.

The man who leaked naked photos of Jennifer Lawrence and Kate Upton has begged the judge overseeing his case to show leniency in his sentencing.
George Garofano has filed documents in his criminal case, hoping for a short prison sentence and home detention after prosecutors recommended he spend 10 to 16 months behind bars.
Garofano insists he has learned from his mistakes and accepts what he did was “legally and morally wrong”, adding, “It will take me a while to forgive myself for this, and I am disappointed in myself for anyone that I hurt, the victims, my family, and my friends.”
In the paperwork, obtained by The Blast, he also wrote: “I feel remorse for anyone that could have been affected by this on any scale, public or private. It is a part of my life that I will always regret, as it has never been a reflection of who I am as an individual.”
Garofano, 26, has also reminded the judge that he has never been in trouble with the law before.
His attorney adds, “Of course, he was old enough to know better even back then, that the conduct he was engaging in was wrong. But he now stands before the Court having matured, accepting responsibility or his actions and not having been in trouble with the law since.”
Garofano also explains his family’s name has been tarnished in his small home town.
He pleaded guilty to hacking over 240 iCloud accounts, including those of Lawrence, Upton, and Kirsten Dunst in April (18), but his attorney maintains his client only played a small role in the scheme and was not the mastermind behind the hacking.
He will be sentenced later this month.

Aretha Franklin Tribute Planned For New York In November

Aretha Franklin will be the subject of a major tribute concert in New York this autumn.
The Queen of Soul, who is reportedly “gravely ill” at her home in Detroit, Michigan, will be honored at a show being organized by Sony Music Chief Creative Officer Clive Davis, who was largely responsible for the singer’s career.
Clive Davis Presents: A Tribute to Aretha Franklin, staged at Madison Square Garden in November, will feature an array of big names, who will be announced in the coming weeks.
Those taking part are expected to perform some of Aretha’s biggest hits, such as Respect, Natural Woman, Chain of Fools, and I Say a Little Prayer.
Meanwhile, the Queen of Soul’s nephew, Tom Franklin, has confirmed the superstar is “sick”, but he insists she and her loved ones are remaining positive about her recovery.
“We believe she’ll pull through it, she believes she’ll pull through it, and that’s the important thing,” he told People.com.
Aretha has been struggling with various health woes in recent years, and secretly underwent surgery to remove a tumor in 2010. Last year (17), she revealed she was set to retire from touring, and in January (18), she was forced to cancel a string of shows on doctors’ orders. She last performed on 7 November at an Elton John AIDS Foundation event in New York City.

Calling Mexican immigrants rapists, referring to African nations as “s**thole countries,” defending a Nazi rally as full of “very fine people.”

But it seems for a huge faction of the country, the smoking gun of hearing him actually say the n-word is still going to be a gotcha.

Many people have been saying for years that such a tape exists and recently Omarosa Manigault-Newman claimed on her tell-all book tour she finally heard it for herself.

It doesn’t help Trump’s case that his response is he’d never use it on “that dog” or that his own press secretary says she “can’t guarantee” tapes of him using the word don’t exist.

But still, Omarosa isn’t the most credible source — after all, she worked in Trump’s White House. So how about a teensy bit of corroboration?

Magician Penn Jillette, who appeared on Celebrity Apprentice in 2012, told Vulture he definitely heard “racially insensitive things” but refused to try and quote because he was worried about inaccuracy.

Can you tell me what you’ve heard him say?

So I can emotionally tell you things that happened racially, sexually, and that showed stupidity and lack of compassion when I was in the room with Donald Trump and I guarantee you that I will get details wrong. I was uncomfortable. “Stress” is the wrong word, but I was not at my best. Then at the end of a day, they put you in a room and they bring out a guy [Trump] who has no power whatsoever and he’s capricious and petty and …

You’ve got to pretend to care what he thinks.
Yeah! It’s your job. You sit at this table and this man rambles — pontificates is giving him too much credit. And because you live in the modern world you’ve heard Trump ramble. But you’ve heard Trump ramble when he thinks he’s being careful. Imagine when he feels he can be frank. And I will tell you things, but I will very conscientiously not give you quotations because I believe that would be morally wrong. I’m not trying to protect myself. This really is a moral thing.

Just so I’m clear: It’s a moral thing because it would be wrong to misquote him or because you don’t want to unduly have an effect on politics?
If he hadn’t become president, I would be telling stories all day long. And if someone were to say, “Penn didn’t get that exactly right,” you’d go “Who cares?”

But now being accurate matters more.
Yeah, the stakes are really high. Not for me. Nothing I can say here hurts my career. But for the world the stakes are higher. He [President Trump] would be reading. And what I’m trying to do here is tell you the story emotionally without telling you specifics.

Okay, I think I follow your logic.
He would say racially insensitive things that made me uncomfortable. I don’t think he ever said anything in that room like “African-Americans are inferior” or anything about rape or grabbing women, but of those two hours every other day in a room with him, every ten minutes was fingernails on chalkboard. He would ask one cast member if he’d rather have sex with this woman or that woman. He would be reading on the web about a real-estate deal he’d made — like he’d sold his house for a certain amount and someone on some blog had said he should have gotten more. Then he would turn and say that making X amount on a house makes him a good businessman, right? I would say to him, “What are you talking about? You don’t know who it is reporting that. Is that Forbes?” He had no idea. So when it came to think about supporting him for president, I digested that information from being on the show with him and said, “Absolutely not. He would be a terrible president.” And because I’d been around him and some people cared what I thought, I said that publicly every chance I got — while also saying he’s a good reality show. You want someone capricious and petty and narcissistic to be on your reality show. And boy, I hate to say this, but playing tapes of him doing that job might be unfair. I want those tapes to be used against him, but it might be unfair.

Because whatever he might’ve said was occurring in the larger context of being on a reality show?
Yeah. You have friends who would say stuff to you over supper that, if you pulled out that chunk, you could ruin their career. But you’ve known them their whole life. You know the exact context. Context is really tricky.

But isn’t there enough of an established behavioral pattern with President Trump that tapes of him saying racially or sexually demeaning things maybe fits into the larger context of who he is and what he thinks?
That is fair. But I can’t stress this enough: I do not respect Donald Trump. Don Junior said — and I’m proud of this — that of everybody who had been on Celebrity Apprentice, I was the one who enjoyed it the most. By the way, I didn’t enjoy it. And I was also the one who liked his father the most. Don Junior said to me, “Why do you like him so much?” And I said, “I made a movie called The Aristocrats.” [Laughs.] (Note: The Aristocrats is a documentary about the dirtiest joke ever told.) I like people when they don’t have filters. I like Tiny TimA very odd, not-so-tiny ukulele player with a high vocal range who become briefly famous in the late ’60s. I like Bob Dylan. I like Neil Young. I like Sun Ra. I love the Beat poets. Which means if I’m in a room with Trump I’m happy to hear him talk. But I’m also happy to hear Charlie Manson talk. I have nothing good to say about Donald Trump as president.

Reality Star’s Family Shocked By Suspected OD Death: ‘This Is Crazy!’

The family of Internet star Lyric McHenry found out about her tragic passing online rather than from their own inner circle, RadarOnline.com learned exclusively.

Shaking her head and wiping tears from her face, McHenry’s distraught grandmother told Radar in an interview that she didn’t know what happened to her but had heard the news online.

“This is crazy,” she cried.

McHenry, 26, was discovered dead Tuesday after a suspected overdose. NYPD confirmed with Radar a woman’s body was found: “On Tuesday, August 14, 2018 at approximately 0505 hours, police encountered a 26-year-old female, unconscious and unresponsive, lying on the sidewalk in the vicinity of Undercliff Avenue and Boscobel Place, within the confines of the 44 Precinct. There were no obvious signs of trauma observed. EMS responded to the location and transported the aided female to Bronx Lebanon Hospital, where she was pronounced deceased. The Medical Examiner will determine the cause of death. The investigation remains ongoing.”

A source tells Radar the 26-year-old was found wearing a pajama top and no pants, sprawled out on a sidewalk, and was allegedly found with a “small ziplock bag containing cocaine.”

She had a few bruises, but no other injuries, according to reports.

Radar can confirm she began her evening at the Frederick Hotel in NYC where she was celebrating her birthday.

Employees at the ritzy establishment told Radar exclusively she was “a lovely woman.”

Lisa Marie Presley Testifies In Nasty Divorce — Accuses Ex Of Stealing ‘Millions’

The ongoing battle between Lisa Marie Presley and her estranged husband Michael Lockwood played out in a Los Angeles court as Elvis’ famous daughter testified her ex stole “millions” from her — and claimed he shouldn’t receive any spousal support, RadarOnline.com can exclusively report.

During her testimony at Los Angeles Superior Court on Tuesday, August 14, Presley said she believed Lockwood reviewed the postnuptial agreement before he signed it on November 2007.

When asked by Lockwood’s attorney Jeff Sturman on whether she thought it was fair that Lockwood did not receive any spousal support if their marriage ended, Presley answered, “Correct.”

“You thought it was fair because you would not have wanted a man who wanted money from you, had you known if he was that way, right?” Sturman asked Presley.

“Not true,” Presley answered.

At the heart of the legal drama between the feuding exes is whether or not the postnuptial agreement signed by Presley and Lockwood is valid. Both sides appeared before Judge Dianna Gould-Saltman on Tuesday to argue over the validity of that agreement.

Presley filed for divorce from Lockwood on June 2016 after 10 years of marriage. They have two twin 9-year old daughters, Harper and Finley.

Presley’s attorney, Gary Fishbein, said in court filings that Lockwood knew he was forgoing spousal support from Presley when he signed the agreement. Lockwood is only now “claiming ignorance,” even when he had a chance to negotiate the postnuptial agreement before signing, Fishbein wrote in an affidavit.

However, Sturman claimed that Presley’s former attorney, Jane Saltsman, allegedly withheld information related to the agreement and took “unfair advantage” of Lockwood.

At Tuesday’s hearing, however, Saltsman testified she had multiple communications with Lockwood’s then attorney, Alan Neiman, concerning the postnuptual agreement. She testified that Neiman told her that Lockwood was “fine” with the agreement, which said Lockwood would not receive spousal support or community properties.

The only thing Lockwood wanted changed in the agreement concerned proceeds from the music the former couple had created together, Saltsman testified.

During her testimony, Presley also said Lockwood had run up her credit card bills into “millions of dollars,” and she only found out about the charges around November 2015. She said she considered those charges as money owed to her by Lockwood, which he has not paid back.

However, when asked by Sturman if Lockwood’s name appeared on the divorce filings that lists their community assets and outstanding debts, Presley said no.

“If she believed she was owned millions of dollars by Michael Lockwood, she would have put that down as an asset,” Sturman told Radar exclusively after the hearing. “That would suggest she didn’t believe there was a such debt owed to her. … One day she says he stole thousands of dollars from her, the next she says ‘millions.’ That is consistent with the way she has testified: she is consistently inconsistent.”

Fishbein declined to comment about the hearing.

The hearing concerning the validity of the postnuptial agreement will continue at Los Angeles Superior Court on Wednesday.
